Can it be based on the rent only. net of real estate taxes.

Yes, it probably should be based on base rent only. I charge 6% of the base rent over the initial term of the lease, paid upfront by landlord. However ALL commission rates are negotiable and it all depends on the broker, the deal specifics, etc.
