Do Texas RE laws allow me to hire a broker in AZ to market and lease my commercial property located in Texas?

I am a Texas Broker who owns the property and would like to hire the AZ Broker for their specialty commercial expertise.

If your a broker, you should know this one... You must have a TX RE Lisc to get paid to sell or lease property in TX. RE 101.

You must hold a license in the state you are leasing your property, so if your broker only has a license in AZ then no, they are unable to lease the property and collect a commission. They may however find you a referral agent and receive a referral fee.

You can hire a RE commercial expert to handle or to work on your behalf. But they must be Management Certified and or have a broker license for that state. If you do not have that state license and or not assigned to your brokerage.

I assume you are part of the Texas Association of Realtors. As such, you have free access to the TAR Legal Hotline and FAQ. It is a better place to have legal questions answered.

You can hire a broker in AZ but he will have to engage the assistance of a Broker in Texas to handle the transaction, marketing, contract negotiations, etc. Typically handled to where the AZ broker would refer it to a Texas broker for a referral fee.
